Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Geemaps Accessibility ("we", "us", "our") at accessibility.geemaps.co.il. By purchasing or using our services, you agree to these Terms.

1. Service Description

Geemaps Accessibility provides a software overlay that adds WCAG 2.1 AA accessibility features (captions, keyboard navigation, screen-reader support, multi-language audio, high-contrast mode) to existing Matterport 3D virtual tours owned by the customer. The service is delivered as a hosted JavaScript layer served from our cloud infrastructure.

2. Pricing and Payment

Our pricing is published at accessibility.geemaps.co.il/#pricing. Setup fees are one-time charges; hosting for the first 12 months following setup delivery is included at no charge. Annual hosting fees of $50 begin from year 2 onward and renew automatically. All prices are in USD unless otherwise stated. Payment is processed by our payment partners and is due before service activation. Cancel renewal any time via written notice to agency@geemaps.co.il at least 14 days before renewal.

3. Customer Responsibilities

• You must own or have explicit permission to modify the Matterport tour you submit.
• You must provide accurate contact and billing information.
• You must not use the service for any illegal purpose or to violate any third-party rights.

4. Delivery and Refunds

Setup is typically delivered within 5 business days of payment and onboarding form completion. If we cannot deliver due to factors within our control, you are entitled to a full refund within 14 days of purchase. After delivery and acceptance, refunds are evaluated case-by-case.

5. Intellectual Property

The accessibility overlay code, designs, and infrastructure remain the property of Geemaps Accessibility. You receive a non-exclusive, non-transferable license to use the overlay on the specific tour(s) covered by your order, for as long as your hosting subscription is active. Captions, translations, and content you submit remain your property.

6. Service Availability

We target 99% monthly uptime for the hosted overlay. We do not guarantee uninterrupted service. We are not liable for downtime caused by Matterport, your hosting provider, or third-party infrastructure outside our control.

7. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

8. Compliance Disclaimer

While our overlay is designed to meet WCAG 2.1 AA criteria, accessibility compliance is a process, not a single deliverable. We do not provide legal warranty against ADA, WCAG, or other accessibility-related claims. Customers are responsible for ongoing compliance audits.

9. Termination

You may cancel your hosting subscription at any time. We may suspend or terminate service for non-payment, breach of these Terms, or abuse of our infrastructure. Upon termination, the overlay is removed from your tour.

10. Governing Law

These Terms are governed by the laws of the State of Israel. Any dispute will be resolved in the courts of Tel Aviv-Yafo.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect.
